Asesoría Fiscal Internacional: La nueva Fiscalía europea contra el fraude recibe el visto bueno de la Eurocámara

La nueva Fiscalía europea se pondrá en marcha en una veintena de países de la UE a partir de 2020 para luchar contra el fraude fiscal El nuevo órgano podrá actuar en casos transfronterizos incluido el fraude al IVA o por el uso de ayudas de la UE como los fondos estructurales, sin tener que esperar a que se cumplan los procedimientos de cooperación judicial habituales, más tediosos y de mayor carga burocrática.

A falta de que los Veintiocho formalicen también su luz verde al proyecto, se prevé que la Fiscalía esté operativa entre 2020 y 2021.

En la actualidad sólo tienen competencia para perseguir el fraude contra la UE las autoridades nacionales, si bien su jurisdicción acababa en sus fronteras.

La nueva Fiscalía pasará a tener jurisdicción en toda la UE pero deberá llevar a los delincuentes directamente ante los órganos jurisdiccionales nacionales.

La sede de la Fiscalía estará en Luxemburgo y su actividad de investigación y procesamiento empezará cuando se cumplan tres años de la entrada en vigor del reglamento que acota su funcionamiento.

Además de las oficinas centrales, la Fiscalía europea contará con fiscales europeos delegados establecidos en los distintos Estados miembros, que compatibilizarán esta ocupación con la de fiscales nacionales.

La nueva Fiscalía permitirá un intercambio rápido de información entre países, investigaciones policiales coordinadas y la rápida congelación e incautación de activos, así como la detención de sospechosos y trabajará de cerca con la agencia de cooperación judicial europea (Eurojust) y la Oficina de la UE contra el fraude (OLAF).

Un total de 20 países de los 28 de la UE, entre ellos España, dieron luz verde en junio a integrarse en la cooperación reforzada para poner en marcha la Fiscalía europea, de la que por ahora no formarán parte Malta, Hungría, Polonia, Reino Unido, Irlanda, Suecia, Países Bajos y Dinamarca.
